Beats Me…….

Now what do lawyers do to arouse such hatred ? Mainly, the problem is that they’re smart. Being smart is definitely démodé these days 😉

For one thing, having to acknowledge that someone other than us is smart is in itself very painful. 😛

Jokes apart….

I am not going to defend Lawyers’ plight….just analyse what makes people despise them.

The only time a person goes to court is when something bad has happened. Court experiences tend to be very negative no matter you win or lose, and lawyers bear the brunt. If you lose, well obviously it’s because your lawyer screwed up and if you win, obviously it’s because you deserved to win. In fact, you would have won even if you didn’t have a lawyer.

The legal system is something that is so complicated that a layman finds it difficult to understand and takes it out on the lawyer.

The law is a huge topic, and the language used is not friendly even to the juniors leave alone the “general public” . People begin to get suspicious if they cannot understand what they are signing, and have to take the lawyer’s word that things are moving in the right direction. Lawyers have their own language, and way of doing things, that is often different from other businesses.

When people shop for dentists , they want the ones who promise ‘least pain’ …while when they do for lawyers , its ‘toughest’…so that they can inflict it on their enemies.
But if they patch up later , more often than not the client justifies his actions and makes his lawyer the scape-goat.
Its like “Sonny dear , I wasn’t aware of what was happening..that meanie bag Lawyer talked me into it” 🙁
Now , how’s that ? You want the meanest , toughest , most ruthless Lawyer for your dirty work , and then you want to wriggle
out of it ‘spotless’ calling him the very names that attracted you to him in the first place.

Also, court business takes a long time for things to get resolved, and they may not be resolved in the way one would like. He is giving control to another person, and also passing on information that is confidential. That puts the client in a not too comfortable position.
Another thing I have noticed is , everyone is wary as soon they know they are dealing with a lawyer. They think , the lawyers won’t hesitate to slap a suit as things are easy for them. I wouldn’t say they don’t have a point.

But the thing that irks me is ,why is the police never made fun of ….except for their infamous paunch , their ethics never becomes the butt of joke.

In what way are lawyers worse than software engineers in the US who go to the US with one company but get their H1 done by 3 companies in no time 😉

But I should add that I do enjoy jokes, period .Be it on Lawyers or any other professional 🙂

yups what u say is perfectly correct.. all clients want to give their opponents a hard time and that is why they pay big bucks for it… but then they do not want to be seen like that by anybody.. hence they pass the entire blame to the lawyer.

also a lawyer makes money (pot loads of it) by charging from a person in distress … often even when the lawyer loses the case for them… i think this is the reason why people hate them so much…

all said and done.. I love lawyer jokes, lawyer books (Parry Mason, and John Grisham) and lawyer soaps (Boston Legal)

BTW this comment is from a guy who has never interacted with any lawyer on a professional basis.

I’m not a software engineer, but only one company can file your H1-B and not three 🙂 You need to be an employee of the company first. And it’s not possible to work full time for three companies together 😛

Basically decisions take too long to come by and our Indian legal system is somewhat flawed. On % basis legal costs are more than most other costs sometimes even greater than the cost of the thing the litigation is about.And even after all that, justice is never guaranteed.

Plus while other professionals pay service tax thanks to lungi micromanager lawyers dont!

They can easily cheat clients as legal system and language is incomprehensible to most mortals

but then again conservatively at least 10% of lawyers are good honest and just – dont u think Ankur ?

Hope u have a great week !

I would’nt say all clients give their Lawyers a tough time , though some are real nervous and apprehensive.
Understandably , the larger the stake the more concerned the clients are…and those famous MNCs are another jittery lot.
Lawyers do make a lot of money , Ankur…but that’s after a lot of sweat and toiling. At that time , the lawyers feel they deserve it and much more. But the free work done by the Lawyers always go unnoticed and when some clients fail to pay the outstanding fees , contrary to what ppl think , the cases are not dropped as that wld leave a very bad impression with the judge.
Its very true that the Lawyer gets paid irrespective of the outcome ,but I’d say when a case is lost the advocate loses more. And its not asif he has not put in his best.
A good Lawyer knows the Law ; a great one knows the Judge. 🙂

yeah…I think we even talked about ‘A Few Good Men’ . I love Tom Cruise in that movie…um..I mean his court room drama 😉 Frankly I liked Jack Nicholson even better.

i think its because of 2 reasons.
1) during the partition…. a lot of sardars moved from pak to different parts of the country… often regions where there were no sikh population prior to this influx.
1) they look different.. very different from other communities.. so its very easy to spot the odd one easily…

What is the purpose for which the poa is being executed ?

It also depends on the policy followed by the agency that is accepting the poa. Some may accept a non-notarised poa while others demand notarisation.

Every state has its own rules regarding execution of poa in respect of immovable properties.

You have to verify with the local subregistrar’s office and find out.

If it is for any other purpose a notarised poa would be sufficient.

Again LOA depends on for what purpose it is given.
In cases of immovable properties LOA is not valid.

the name wld be mentioned on the stamp paper and it can be used by the said person only.

No. Its absolutely non-transferable , even to a family member. However , the stamp can be used by the person in whose name it was purchased at any time thereafter.

on stamp ppr is it not enough for the holder to be a party to/in a contract or agreement even if he / she is not the primary party?

i asked about notorisation in POA because in most cases kids go abroad and parents cant get the damn thing notorised (finding difficulty to operate accounts and manage investments on kids names )-
so how valid would it be for a poa of say ur family member – if it is fr managing investments and bank accounts but sans the noting?

this is the one where I wanted to make sure before answering.
As far as the party on whose name the stamp was purchased is a party to the transaction , it is valid. He/She need not be the primary party.

poas are registered , Prax. Banks expect us to give them a COPY of the registered poa which is duly notarised .

Prax , anybody can send a notarised letter from any country to India. I am not sure about the procedure , but I know its done through the Indian Consulate. If u need the details , I can get it for u.

r u a law student doin llm or somethin of sort or r u practicing? i quit law after i was not allowed to sit for the fy law as i didnt attend some practical lectures (that after i miraculously passed when i thought i would fail the mid term – based on 3 hr study of what my portion was)
the whole workmens compensation act coupled with 7am class gave me loads of sleep

wireless problems ? yes. I got the modem from BSNL but the technicians cld’nt make it work 🙁 Ankur helped , but he said there is some configuration that need to be done in the lappie and with this vista thing I am having headaches.

its almost exactly like windows… but much more geekier… god people r having PDAs run on linux… and u r worried about a dumb computer…

btw linux supports dual boot.. so u can have windows and linux on the same machine ..
